Salon Terms Of Service, Disclaimer,
Service Provider Notice, And Dispute Resolution Policy

By booking an appointment, receiving services, purchasing products, accessing this website, or otherwise engaging with the salon, you acknowledge that you have read, understood, and agree to the following terms and conditions.

Definitions

For purposes of these Terms of Service, Disclaimer, Service Provider Notice, and Dispute Resolution Policy:

“Salon” refers to the salon business, its owners, managers, employees, affiliates, successors, and assigns.

“Service Provider” refers to any hairstylist, colorist, barber, esthetician, makeup artist, nail technician, beauty professional, or other individual providing services within or through the Salon who operates as an independent service provider and not as an employee of the Salon.

Each Service Provider independently owns and operates his or her business and is solely responsible for the services provided, including but not limited to consultations, recommendations, products used, pricing, scheduling, service techniques, customer communications, and service outcomes.

Unless otherwise expressly stated in writing, Service Providers are not employees, agents, joint venturers, partners, or representatives of the Salon, and the Salon does not control the professional judgment, methods, techniques, products, pricing, scheduling, or business operations of any Service Provider. All Service Providers providing services within or through the Salon are independent contractors and are not employees of the Salon.

“Client” refers to any person who books an appointment, receives services, purchases products, accesses the Salon’s website, or otherwise engages with the Salon or a Service Provider.

1. Consultation and Disclosure

Clients are responsible for providing complete and accurate information to their Service Provider regarding their hair and beauty service history, including but not limited to prior coloring, bleaching, chemical treatments, relaxers, perms, keratin treatments, extensions, medications, allergies, sensitivities, scalp conditions, and any other information that may affect the services provided. Failure to disclose relevant information may affect service results and may increase the risk of adverse outcomes.

2. No Guarantee of Results

Hair and beauty services are artistic and involve variables beyond the control of the Service Provider. While every effort will be made to achieve the Client’s desired results, no guarantees, warranties, or representations are made regarding the outcome of any service. The Salon does not guarantee, warrant, or represent any results of any service provided by a Service Provider.

Results may vary based on hair type, texture, condition, previous treatments, maintenance practices, and other factors.

3. Risks Associated with Services

Clients acknowledge and accept the inherent risks associated with salon services performed by the Service Provider, including but not limited to:

  • Hair breakage or damage
  • Dryness or texture changes
  • Color variations or unexpected color results
  • Allergic reactions or sensitivities
  • Scalp or skin irritation
  • Chemical burns or discomfort
  • Dissatisfaction with service results
  • Other unintended outcomes despite the exercise of reasonable care

Clients voluntarily assume all risks inherent in receiving salon services performed by the Service Provider.

4. Allergies and Sensitivities

Salon products may contain ingredients that could cause allergic reactions or sensitivities.

Clients are responsible for informing their Service Provider of any known allergies, sensitivities, medical conditions, or prior adverse reactions.

Patch testing may be recommended or required for certain services. Declining a patch test may increase the risk of an adverse reaction.

5. Hair Condition and Prior Treatments

The Salon and Service Provider shall not be responsible for damage, breakage, color inconsistencies, or other adverse outcomes resulting from:

  • Undisclosed prior chemical treatments
  • At-home hair services
  • Previously damaged hair
  • Inaccurate information provided during consultation
  • Medications or medical conditions affecting hair or skin
  • Failure to follow aftercare instructions

6. Refund Policy

No refunds will be issued by the Salon.

7. Maintenance and Home Care

Proper maintenance and home care are essential to preserving service results.

The Salon shall not be responsible for fading, discoloration, damage, or changes in appearance resulting from improper maintenance, environmental exposure, swimming, heat styling, use of non-recommended products, or failure to follow aftercare instructions.

8. Service Provider Notice

Certain hairstylists, colorists, barbers, estheticians, makeup artists, and other beauty professionals providing services within the Salon operate as Service Providers and are not employees, agents, partners, or representatives of the Salon.

Each Service Provider is independently responsible for the services they provide, including consultations, recommendations, products used, techniques performed, scheduling, pricing, customer communications, and service outcomes. Each Service Provider is also solely responsible for operating their own business and handling all matters relating to their Clients.

9. Service Complaints and Disputes

Any concerns, complaints, disputes, refund requests, requests for service redos or corrections, appointment cancellations, no-shows, scheduling disputes, payment disputes, client dissatisfaction with services, pricing or communications, or other claims relating to services performed by a Service Provider should be directed to the individual Service Provider who performed the service. The Salon, its ownership, management, and staff are not responsible for, and will not become involved in, disputes between the Service Provider and their Clients.

The Service Provider understands that all such matters must be handled directly by the Service Provider and their Client without expectation of intervention by the Salon, its owner, management, or staff.

10. Circumstances Where Management May Intervene

Salon management may intervene only if a matter escalates to a level that affects the safety, security, or operation of the Salon, including but not limited to:

  • Threats, intimidation, or harassment
  • Aggressive, hostile, or disruptive behavior
  • Property damage or destruction
  • Disturbance of salon operations, staff, renters, Service Providers, or other clients
  • Situations involving safety concerns
  • Circumstances where law enforcement or emergency services may need to be contacted.

In such cases, Salon management reserves the right to take any action deemed necessary to protect the Salon, its occupants, and its business operations, including requiring a party to leave the premises and/or contacting law enforcement.

11. Limitation of Salon Responsibility

To the fullest extent permitted by applicable law, the Salon shall not be responsible for the acts, omissions, recommendations, products, services, pricing, scheduling, or professional judgments of Service Providers operating within the salon.

Any claim arising from services performed by a Service Provider should be addressed directly with the Service Provider responsible for providing the service, except where liability is otherwise required by law.

12. Release and Limitation of Liability

To the fullest extent permitted by applicable law, the Salon, its owners, managers, employees, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to services provided, use of this website, or interactions with Service Providers.

Nothing in this policy is intended to waive liability that cannot be waived under applicable law.

13. Photography and Social Media

The Salon may photograph or record video services, salon activities, and completed work for marketing, educational, promotional, or social media purposes.

Clients who do not wish to be photographed or recorded should notify their Service Provider before services begin.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles.

15. Dispute Resolution

By booking an appointment, receiving services, purchasing products, accessing this website, or otherwise engaging with the Salon, you agree that any dispute, claim, or controversy arising out of or relating to services provided at the Salon, this website, or any Service Provider operating within the Salon shall first be submitted to good-faith mediation.

Mediation

Before initiating litigation, the parties agree to attempt to resolve disputes through mediation conducted in the county where the Salon is located. The parties shall share mediation costs equally unless otherwise agreed.

Binding Arbitration

If mediation does not resolve the dispute within sixty (60) days of a written request for mediation, the dispute shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) or another mutually agreed arbitration provider in accordance with its applicable consumer arbitration rules.

The arbitration shall occur in the county where the salon is located unless otherwise agreed in writing.

The arbitrator shall have exclusive authority to determine the interpretation, applicability, enforceability, and scope of this arbitration provision.

Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE SUBJECT TO THIS PROVISION.

Waiver of Class Actions

All disputes shall be resolved on an individual basis only. Class actions, collective actions, representative actions, and consolidated proceedings are expressly waived.

Attorneys’ Fees and Costs

Each party shall bear its own attorneys’ fees and costs unless otherwise awarded by the arbitrator or required by law.

Exceptions

Nothing in this section shall prohibit a party from:

  • Filing a qualifying claim in small claims court;
  • Seeking temporary injunctive relief;
  • Seeking emergency equitable relief as permitted by law.

Survival

This Dispute Resolution section shall survive the completion of services and any termination of the relationship between the parties.
